Content Overview

This is a full-day session that covers detailed risk allocation and performance requirement principles for collaborative delivery projects, including specific commercial language, sources/content of contracts, and commonly accepted practices for construction management at-risk (CMAR), progressive design-build (PDB), and fixed-price design-build (FPDB) contracts. Building on the sixth edition of the Water and Wastewater Collaborative Delivery Handbook, this in-person session is expanded to cover:

  • An overview of common terminology and collaborative delivery practices in the water/wastewater market
  • How performance risk allocation and related contractual terms are viewed through a performance accountability lens for collaborative delivery projects
  • What additional contract terms must be included to support effective two-phase, open-book CMAR and PDB contracts with an off-ramp option
  • How specific statutes in key states may affect collaborative delivery plans
  • How federal requirements for grants and loan programs apply to the procurement and delivery of collaborative delivery projects
  • An overview of recent DBIA contract forms changes, the newly available WCDA CMAR contract template, and other widely used sources for collaborative delivery contracts
